Jack Harris Design & Print - Our terms & conditions
Don't worry; we just need you to read through these terms and conditions so that you understand our design process and are fully aware of your rights as client.
All terms and conditions relating to the supply of products from Jack Harris Design & Print are shown below. Please read all terms and conditions carefully before placing an order. By ordering any of our products, you agree to be bound by these terms and conditions.
1. Service Availability
Jack Harris Design & Print is intended for use only by people resident in the United Kingdom. We do not accept orders from outside the UK.
2. Your Status
By placing an order through our website you warrant that:
- You are legally capable of entering into a binding contract.
b. You are at least 18 years old.
c. You are resident in the United Kingdom
3. General
All work is carried out by Jack Harris Design & Print on the understanding that the client has agreed to our terms and conditions.
4. Copyright
Copyright is retained by Jack Harris Design & Print on all design work, including words, pictures, ideas, visuals and illustrations (unless specifically released in writing) until all costs have been settled.
If a choice of design is presented, only one solution is deemed to be given by Jack Harris Design & Print as fulfilling the contract. All other designs remain the property of Jack Harris Design, unless agreed in writing that this arrangement has been changed.
5. The Design Brief and Project Acceptance
A design brief will need to be supplied to us or preferentially filled out via the contact section of our website. No work can commence without a design brief to supply to our designers.
At the time of proposal, Jack Harris Design & Print will provide the customer with a written estimate or quotation via email and a link to the terms and conditions page that must be read and accepted before any work can commence.
6. Design Charges & Deposits
Charges for design services to be provided by Jack Harris Design & Print, will be set out in the written estimate or quotation that is provided to the customer. At the time of the customer's acceptance of this estimate or quotation, indicating acceptance of the Terms & Conditions, a non-refundable deposit of 30% of the quoted fee may become immediately due dependent upon the type of project and the regularity of the client. In the event that Jack Harris Design & Print deem it necessary to take a deposit, work on the project will not commence until Jack Harris Design & Print has received this amount in full.
7. Charges for Other Services
Charges for any additional services over and above the estimated design will become fully payable (100% of the quoted amount) at the time of estimate or quotation acceptance.
8. Product Prices
Jack Harris Design’s website contains a large number of Products and it is always possible that, despite our best efforts, some items may on occasion be incorrectly priced. Jack Harris Design is under no obligation to provide the product to you at the incorrect (lower) price if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as ‘mis-pricing’.
9. Payment
The customer will be provided with an online artwork sign off form and an email invoice prior to design work being submitted to print. At this time the remainder of the amount due will become payable. Accounts that remain outstanding for 30 days after the date of invoice, will incur an extra charge of 2% per month of the outstanding amount.
Payments may be made by cash, cheque, direct transfer or paypal Money request.
Publication and/or release of work done by Jack Harris Design on behalf of the client, may not take place before cleared funds have been received.
10. Default Accounts
An account shall be considered default if it remains unpaid for 30 days from the date of invoice, or following a returned cheque. Jack Harris Design & Print shall be considered entitled to remove Jack Harris Design & Print’s and/or the customer's material from any and all computer systems, until the amount due has been fully paid. This includes any and all unpaid monies due for services, including, but not limited to, hosting, domain registration, search engine submission, design and maintenance, sub-contractors, printers, photographers and libraries.
Removal of such materials does not relieve the customer of their obligation to pay the due amount. Customers whose accounts become default agree to pay Jack Harris Design & Print reasonable legal expenses and third party collection agency fees in the enforcement of these Terms and Conditions.
11. Copyrights and Trademarks
By supplying text, images and other data to Jack Harris Design & Print for inclusion in the customer's website or other medium, the customer declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the customer, or rightful copyright or trademark owner.
Any artwork, images, or text supplied and/or designed by Jack Harris Design & Print on behalf of the customer, will remain the property of Jack Harris Design & Print and/or it's suppliers.
By supplying images, text, or any other data to Jack Harris Design & Print, the customer grants Jack Harris Design & Print permission to use this material freely in the pursuit of the design.
Should Jack Harris Design & Print, or the customer supply an image, text, or any other file for use in a website, multimedia presentation, print item, exhibition, advertisement or any other medium believing it to be copyright and royalty free, which subsequently emerges to have such copyright or royalty usage limitations, the customer will agree to allow Jack Harris Design & Print to remove and/or replace the file on the site.
The customer agrees to fully indemnify and hold Jack Harris Design & Print free from harm in any and all claims resulting from the customer in not having obtained all the required copyright, and/or any other necessary permissions.
12. Alterations
The customer agrees that changes required over and above the estimated work or required to be carried out after acceptance of the draft design will be liable to extra art-working charges charged by the hour.
The customer also agrees that Jack Harris Design & Print holds no responsibility for any amendments made by any third party, before or after a design is published.
The customer is entitled to minor changes after the first proof is received. Major changes will be changed by the hour.
If a client changes their mind entirely about the content and look of a design after the design has been produced, they shall still be held accountable to pay the design charge for the work.
13. Licensing
Any design, copywriting, drawing or idea created for the customer by Jack Harris Design & Print, or any of it's contractors, is licensed for use by the client on a one-time only basis and may not be modified, re-used, or re-distributed in any way or form without the express written consent of Jack Harris Design & Print and any of it's relevant sub-contractors.
All design work- where there is a risk that another party make a claim, should be registered by the client with the appropriate authorities prior to publishing or first use or searches and legal advice sought as to its use. Jack Harris Design & Print will not be held responsible for any and all damages resulting from such claims.
Jack Harris Design & Print is not responsible for any loss, or consequential loss, non-delivery of products or services, of whatever cause. The customer agrees not to hold Jack Harris Design & Print responsible for any such loss or damage. Any claim against Jack Harris Design & Print shall be limited to the relevant fee(s) paid by the customer.
14. Delivery
Delivery is by courier or collection from our office.
We will inform you via email of your expected delivery date. Jack Harris Design & Print cannot be held responsible for delays in delivery.
Delivery is re attempted at least once and usually twice after initial delivery, and a calling card will be left for clients to re-organise the delivery or collection of their own parcel.
It is not the responsibility of Jack Harris Design & Print to re-organise your delivery if you were unable to accept consignment at time of delivery.
We will not supply you with a tracking number unless you specifically request one.
15. Data Formats
Image formats accepted (.jpg / .psd / .ai / .pdf ) other types accepted but not preferred.
The client agrees to Jack Harris Design & Print’s definition of acceptable means of supplying data to the company.
Images supplied to us for print must be in CMYK with a resolution of 300DPI and supplied with a 3mm bleed.
Text is to be supplied to all image formats accepted in electronic format as standard text (.txt), MS Word (.doc) on CD-ROM, or via e-mail.
15. PRINT DATA AND OBLIGATIONS TO CHECK IT
We will carry out all print orders solely on the basis of the print data sent by you. Error-free printing is not guaranteed in the case of differing data formats or other specifications.
You must carefully check the print data to determine whether it is suitable for the order before sending it to us. We will not check the print data and the customer alone will bear the risk of any errors in the printed Products owing to incorrect data supplied.
At your express request, formats other than those specified in the customer information will be processed, where technically feasible. If errors occur as a result of using these formats, responsibility will be borne by the customer and not by Jack Harris Design & Print.
We can convert print data not sent in CMYK mode, but such conversion will be at the customer’s risk. Conversion of RGB data or ICC colour profiles will naturally result in deviations in colour from the original and, again, liability for these deviations will lie solely with the customer.
16. Supplied Images
Images which are supplied in an electronic format, are to be provided in a format as prescribed by Jack Harris Design via a CD-ROM, or e-mail. Images must be of a quality suitable for use without any subsequent image processing, and Jack Harris Design will not be held responsible for any image quality which the client later deems to be unacceptable.
17. Stock Imagery / Vectors
Stock imagery may be used in your work, which can be chosen by you at the time of submitting a brief.
Upto 2 stock images can be purchased within the design fee. Extra stock images are charged at £8 each.
Additional expenses may be incurred for any necessary action, including, but not limited to, photography and art direction, photography searches, media conversion, digital image processing, or data entry services.
18. Design Project Duration
Any indication given by Jack Harris Design of a design project's duration is to be considered by the customer to be an estimation. Jack Harris Design cannot be held responsible for any project over-runs, whatever the cause. Estimated project duration should be deemed to be from the date that cleared funds are received by Jack Harris Design for the initial deposit payment or by date confirmed in writing by Jack Harris Design.
19. Design Project Completion
Jack Harris Design considers the design project complete upon receipt of the customer's artwork signoff form. Jack Harris Design will consider that the client has accepted the original draft, if no notification of changes is received in writing from the customer within 14 days of the start of the review period.
If a client has not responded by accepting the artwork sign-off form within 21 days of the artwork proof being sent for approval, the full design charge will be due immediately.
20. Hosting websites
Jack Harris Design does not offer in-house hosting services. Jack Harris Design can only suggest possible sub-contractors and does not guarantee continuous service and will accept no liability for loss of service, whatever the cause. Jack Harris Design may request that clients change the type of hosting account used if that account is deemed by Jack Harris Design to be unacceptable because of poor service, lack of bandwidth or in any other way insufficient to support the website. Fees due to the hosting organisation are the responsibility of the client/. Jack Harris Design is not liable for their payment.
21. Domain Registration
Jack Harris Design cannot guarantee the availability of any domain name. Where Jack Harris Design is to register a domain name on behalf of a client, it will endeavour to do so but the client should not assume a successful registration.
22. Search Engine Submission
Due to the infinite number of considerations that search engines use when determining a site's ranking, Jack Harris Design cannot guarantee any particular placement. Acceptance by any search engine cannot be guaranteed and when a site is accepted, the time it takes to appear in search results varies from one search engine to another. Rankings will also vary as new sites are added.
23. Design Credits
The customer agrees to allow Jack Harris Design to place a small credit on printed material, exhibition displays, advertisements and/or a link to Jack Harris Design’s own website on the customer's website. This will usually be in the form of a small logo or line of text placed towards the bottom of the page.
The customer also agrees to allow Jack Harris Design to place websites and other designs, along with a link to the client's site on Jack Harris Design’s own website for demonstration purposes and to use any designs in its own publicity.
24. Reproduction of Work
Work supplied to the client remains the property of Jack Harris Design until the invoice has been paid in full.
Clients wishing to source their own printing for our design work must state this before any work commences on the project.
25. Rights of Refusal
Jack Harris Design will not include in its designs, any text, images or other data which it deems to be immoral, offensive, obscene or illegal. All advertising material must conform to all standards laid down by all relevant advertising standards authorities. Jack Harris Design also reserves the right to refuse to include submitted material without giving reason. If any images and/or data that Jack Harris Design includes in good faith, and then finds out that it contravenes these terms and conditions, will be removed without hindrance, or penalty. Jack Harris Design is to be held in no way responsible for any such data being included.
26. Complaints
Obvious defects in delivered goods must be reported to us within 2 weeks of receipt.
Complaints made solely because you have failed to heed the information on requirements for the print data cannot be raised. This shall apply in particular to printed matter that is based on RGB colours, and is in a resolution that is too low, or where fonts that are not embedded are used.
Slight deviations in colour will not be regarded as defects.
27. Damaged goods
If part of the delivery has defects, this will not authorize the customer to object to the entire goods.
If the supplied goods are entirely defective or lack warranted qualities, Jack Harris Design- at its discretion - will supply a replacement or remedy the goods, to the exclusion of further warranty claims by the customer.
For this we need to see a high quality photograph of the defect.
28. Cancellation
Cancellation of orders may be made initially by telephone contact, or e-mail, however, following this, Jack Harris Design will need formal notification in writing to the company's postal address. The client will then be invoiced for all work completed over and above the non-refundable deposit that may have been made at the time of first ordering. In the case of a cancellation when no deposit was taken, the client will still be invoiced for all work completed so far. The balance of monies due must be paid within 30 days. Please note: any cancellation which is not formally confirmed in writing and received by Jack Harris Design within 14 days of such instruction being issued, will be liable for the full quoted cost of the project.
However, you will not have any right to cancel a contract for the supply of any of the products because the cancellation rights do not apply to the sale of custom-made articles or goods made to a consumer’s specification.
29. Disclaimer
Jack Harris Design makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. Jack Harris Design will not be held responsible for any and all damages resulting from products and/or services it supplies. Jack Harris Design is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The customer agrees not to hold Jack Harris Design responsible for any such loss or damage. Any claim against Jack Harris Design shall be limited to the relevant fee(s) paid by the customer.
Jack Harris Design reserves the right to use the services of sub-contractors, agents and suppliers and any work, content, services and usage is bound by their terms and conditions. Jack Harris Design will not knowingly perform any actions to contravene these and the client also agrees to be so bound.
30. General
These terms and conditions supersede any previous terms and conditions distributed in any form. Jack Harris Design reserves the right to change any rates and any of the terms and conditions at any time and without prior notice.
31. Acceptance of Quotation and Terms and Conditions
The placement of an order for design and/or any other services offered by Jack Harris Design and validated by the customer's signature on the estimate or quotation form, constitutes acceptance of the estimate or quotation and agreement to comply fully with all the terms and conditions, and forms a Contract for Business between the signatory and Jack Harris Design.
Please print a copy of these terms and conditions for future reference.
